you only use your sec 14 powers when you have to we voluntary lots of folk to the office for interview. The scottish system isnt bogged down like pace is we have a freedom of law you dont, Your arrest system is time consuming and the system you use to prepare cases and put them before CPS for bail decisions seem strange. We make our own decisions wither release for report , undertaking or custody.

Plus none of this lawyer in interview nonsense wink.gif

Do you have to give them "their phone call"

Sarge- 08-28-2006
I'm sure they dont, just have to inform someone of their arrest

It's the same here, they get somebody informed of their arrest, discretion is used whether to let them personally make it.

No way, neds that are locked up dont get a sniff of a phone .

Over here they get the right to telephone or speak to a friend, relative or lawyer and have them present during questioning. We have the right to exclude a person if they have something to do with the offence or they are being a nuisance in the interview. Most don't want someone present but if they do we have to give a reasonable time for that person to attend and be present.

We can hold someone for investigations and inquiries into an indictable offence for 8 hours. We can question that person for only 4 hours.

We very rarely "'arrest" for cancelled licence offences and our drink driving laws allow us to have an offender for this offence in custody without arrest, so as a traffic unit, I do not have many "lock ups" other than the occaisonal drunk/public order offence. Being in a rural area, the GD lads and lasses scoop them up pretty quick to keep thier own work rate looking acceptable. I also like to give them the rare drug offender ortea leaf that I run down. ( I am not seeking transfer or promotion at the moment and if I can help someone else look good then go for it I say.)cool.gif

I can't find a way to let them do a fata crash investigation though. ipf/sick.gif dry.gif
